Wage and Hour Claims

Employees are entitled to be properly compensated for the time they spend at work. This is commonly seen where individuals are compensated by the hour versus a salary. In many cases, employees are forced to work over time, but are not properly paid OR paid at all for their extra time at work.   • Failure to pay minimum wage as required by law;
  • Failure to provide rest breaks and meal breaks as required by law;
  • Improper paycheck deductions;
  • Failure to pay wages due upon termination

The Fair Labor Standards Act (FLSA) provides a remedy for employees who have not been properly compensated for their overtime work by their employer. The FLSA establishes minimum wage, overtime pay, record keeping and youth employment standards affecting employees and provides penalties to those employers who refuse to adequately compensate their employees.
